How We Collect or Receive Personal Data from You When you Visit the Website
Amway collects personal data from you through your use of the Website in various ways.
You may choose to submit your personal data and other information to us through various communication channels provided on the “Contact Us” webpage of the Website, for example, Amway e-mail addresses, telephone numbers or online forms.
Where we ask you to provide us with your personal data, we will indicate whether providing the personal data is a statutory or contractual requirement, or a requirement necessary to enter into and/or facilitating a contract, as well as whether you are obliged to provide the personal data and of the possible consequences of a failure to provide the personal data.

The Types of Personal Data We Collect From Visitors
Through the cookies listed above under the section “How We Collect or Receive Personal Data from You” we collect information regarding your website usage, IP-address, browser type and operating system. How We Collect or Receive Personal Data from You When You Are Registering as a Customer
Amway collects and receives personal data from its Customers in various ways.
We collect personal data from you when you register as a Customer on our websites. You may also choose to submit your personal data and other information to us through various communication channels provided on the “Contact Us” webpage of our websites, for example, Amway e-mail addresses, telephone numbers or online forms.
We also receive personal data of our Customers from the IBOs with whom the concerned Customers have an existing relationship (such as when Customers have bought Amway products from the IBO).
The Types of Personal Data We Collect From Customers
If you are registering as a Customer directly with Amway, we collect the following personal data from you:
- Contact information (e.g., name, postal or e-mail address, fax number and phone number);
- Date of birth;
- Login Information incl. Username, Connect ID and Password;
- Payment information (e.g., bank account or credit card numbers);
- Product preferences, purchasing habits, purchasing history and spending behavior
- Information about calls you make to our call centers (e.g., a recording of the call); and
- Communication preferences.
In addition, when you communicate with us through various communications channels, we collect your contact details, such as your name, email address, address, telephone number and/or fax number. You may also voluntarily provide other data that is related to you in connection with your inquiries or comments. We encourage you, however, to provide no more personal data relating to you than is necessary in order for us to provide an appropriate response to your inquiries or comments.
How We Process the Personal Data We Collect
We only process your personal data to the extent it is necessary (i) for the performance of your agreement with us or in order to take steps at your request prior to entering into an agreement with us; or (ii) to comply with our legal obligations.
Therefore, we process the personal data we obtain about you to:
- Manage your registration as a Customer;
- Create and manage your online account;
- Address your comments or inquiries
- Process your orders of products or services;
- Communicate with you;
- Bring you in contact with your IBOs (including providing your name, address, telephone number or e-mail address, purchases and purchasing history to your IBO);
- Operate, evaluate and improve our services and facilitate your use of our websites;
- Perform accounting, auditing, billing and collection activities;
- Comply with applicable legal requirements, industry standards and our policies.
- Operate, evaluate and improve our services; and
- Prevent and protect us and others against fraud, unauthorized transactions, claims and other liabilities.
How We Share Personal Data
Amway does not sell, rent or trade your personal data. Amway does share your personal data with:
- Entities within the Amway group to whom it is reasonably necessary or desirable for Amway to disclose personal data to allow Amway to co-ordinate the above-mentioned purposes with those group entities, and to allow Amway to use shared group resources so that we can provide registration and website services to you;
- IBOs, to allow communication regarding products, services and orders relating to the Amway Business;
- Providers of Infrastructure- or Platform- or Software-as-a-Service solutions, software development services, information system maintenance services, record management services. This allows Amway to provide relevant website functionality to Customers and Visitors; and
- Government authorities or other third parties, to comply with our legal obligations as well as the legal obligations of our subsidiaries and affiliates, if required by law or reasonably necessary to protect the rights, legal interests, property or safety of others or ourselves.
This is a fundamental part of Amway’s business model and allows Amway to co-ordinate its relationship with you; consent is not required to carry out the above-mentioned transfers. Amway does not receive any consideration for personal information and those who receive your personal information from Amway must not sell.
Data Transfers
We transfer the personal data we collect about you to entities within the Amway group, including Amway’s parent company Alticor Inc. Some of them may be located in countries other than the country in which the data were originally collected. The laws of those countries may not have the same level of data protection as the country in which you initially provided the data. When we transfer your personal data to other countries, we will protect that data as described in this Privacy Notice and in accordance with applicable law.

Furthermore, some of the third-party service providers that process personal data on our or Amway group entities’ behalf are located in countries outside the country in which the data were originally collected. Your Rights
Your rights under applicable law may include access to the personal data we process about you, the right to have such personal data corrected, erased or cancelled, the right to restrict the processing of your personal data, and the right to withdraw your consent at any time. This will not affect the lawfulness of the processing that has happened based on your consent prior to the withdrawal. You also have the right to object to the processing of your personal, at any time data, per the terms of applicable law. To exercise these rights, you should make a written request to our Data Protection Officer using the contact details set out below. If you are not satisfied with the way we handle your request, you may lodge a complaint with a supervisory authority.
This request needs to comply with the applicable law and must contain and attach the following:
- Full name and the email address, at which you will receive the response to your request
- A copy of your official identification with your photo, (or if applicable, a copy of your legal representative’s official identification with his/her photo and documents that evidence his/her authority).
- A clear and precise description of the rights you want to exercise.
- For requests related to your right to correct personal data, the modifications to be carried out and the documents that support your request.
Our Data Protection Officer will process and respond the applicable requests within 20 (twenty) business days of receipt. If the request is valid, it shall be executed within fifteen (15) business days from the date the response was issued. The response will be given electronically to the email address specified in your letter, including if applicable, an electronic copy of the requested personal data.
Amway may extend (once) the timescales set out in the previous paragraph, whenever warranted by the circumstances.

- Payment information (e.g., bank account or credit card numbers);
- IBO performance information (e.g., class, status, group and personal qualifications under the Amway Sales and Marketing Plan and financial/bonus history);
- Information about calls you make to our call centers (e.g., a recording of the call);
- Product preferences, purchasing habits, purchasing history and spending behavior; and
- Communication preferences.
How We Use the Personal Data We Collect
We only process your personal data to the extent it is necessary (i) for the performance of your agreement with us or in order to take steps at your request prior to entering into an agreement with us; or (ii) to comply with our legal obligations;
Therefore, we process personal data we obtain about you to:
- Manage your registration as an IBO, view the Terms & Conditions of your registration as an IBO;
- Create and manage your online account and respond to your inquiries;
- Process your orders of products or services;
- Communicate with you (e.g., about products or services that we offer, or intend to offer);
- Operate, evaluate and improve our services and business, including by:

How We Share Personal Data
Amway does not sell, rent or trade your personal data. Amway does share your personal data with:
- Entities within the Amway group to whom it is reasonably necessary or desirable for Amway to disclose personal data;
- Vendors or Service Providers to whom it is reasonably necessary or desirable for Amway to disclose personal data;
- Registered IBO Organizations (“Approved Provider”) with whom you are associated;
- IBOs, to allow communication regarding products, services and orders relating to the Amway Business;
- Independent Business Owners Association International, to facilitate whether you qualify to vote for its Board;
- Administrators/Brokers of Third-Party Insurances, to facilitate providing insurances to you as an IBO;
- Providers of Infrastructure- or Platform- or Software-as-a-Service solutions, software development services, information system maintenance services, record management services or communication services. This permits Amway to fulfill its obligations towards you as an IBO; and,
- Government authorities or other third parties to comply with our legal obligations as well as the legal obligations of our subsidiaries and affiliates, if required by law or reasonably necessary to protect the rights, legal interests, property or safety of others or ourselves.
This is a fundamental part of Amway’s business model and allows Amway to co-ordinate its relationship with you as an IBO; consent is not required to carry out the above-mentioned transfers. Amway does not receive any consideration for personal information and those who receive your personal information from Amway must not sell.
Data Transfers
We transfer the personal data we collect about you to entities within the Amway group, including Amway’s parent company Alticor Inc. Some of them may be located in countries other than the country in which the data were originally collected. The laws of those countries may not have the same level of data protection as the country in which you initially provided the data. When we transfer your personal data to other countries, we will protect that data as described in this Privacy Notice and in accordance with applicable law.

Business Center Privacy Notice
This Business Center Privacy Notice (“Notice”) applies to the personal data collection and further processing by Amway Corp., a Virginia entity with its principal place of business at 7575 Fulton Street East, Ada, MI 49355, and its affiliates and subsidiaries (“Amway,” “we,” “us,” “our”) through the Amway Business Center mobile application (“Business Center App”), including while downloading and/or streaming the Business Center App. The Business Center App is an app developed for Amway Business Owners (“ABOs”) and potential ABOs (collectively “you”) to help them progress their professional development and trace the growth of a prospect into an ABO. This Notice explains how we process personal data collected from you via the Business Center App.
Amway respects individuals’ privacy and values the confidence of its associates, customers, vendors and others with whom we do business. Amway strives to collect, use, disclose and otherwise process personal data in a manner consistent with the laws of the countries in which we do business, and we pride ourselves on upholding the highest ethical standards in our business practices.
We evaluate our privacy notices and procedures to implement improvements and refinements from time to time. If we make material changes to this Notice, we will notify you by means of a prominent notice on the Business Center App, by email, or by other communication means prior to the change becoming effective.
When Does This Notice Apply?
We will process personal data that we collect from you or that you provide to us via the Business Center App in accordance with this Notice.
This Notice does not apply to personal data that we collect from you in connection with your use of an Amway website. Please read our website privacy notice to find out more about such data processing. The Notice also does not apply to personal data that we collect from you in connection with the provision of Amway products and services. Personal Data We Collect
We collect and process the following information about you in relation to the Business Center App:
Information you give to us: In order to start using the Business Center App, we ask you to give us your Amway ID and party ID, ABO ID and user ID, your password, your email address, phone number, your country of registration (to the extent you have enabled the location settings on your device), image and product preferences and other profile information to launch the Business Center App. Depending on which functionalities of the Business Center App you choose to use, we ask you to give us your prospect and product pictures uploads, and your avatar name. More generally, you can also choose to give us your personal data when you fill out forms on the Business Center App, register for events through the Business Center App or correspond with us, for instance to report a problem in relation to the Business Center App, or when you choose to submit a “User Contribution”.
You may choose whether or not to provide us with your personal data, but the functionality of the Business Center App will only be available if we have certain personal data about you. If you do not provide us with the required personal data, you cannot access and/or enjoy specific functionalities in the Business Center App.
Information we collect from you when you use the Business Center App: Each time you access the Business Center App we automatically collect information regarding your use of the Business Center App, including your Amway ID and password, your content views, device type and operating system you use to access the Business Center App, information on error messages that occur during your use of the Business Center App and your selection and purchase of Amway products.
How We Use Your Personal Data
We process your personal data in order to:
- perform our obligations under the agreement we have with you. The collection and processing of your personal data is necessary for us to provide you with the functionalities of the Business Center App;
- comply with our legal obligations;
- pursue our legitimate interests including operating, evaluating and improving our business; preventing and protecting us and others against fraud, unauthorized transactions, claims and other liabilities; and ensuring compliance with company policies and industry standards.
Where legally required, we will ask for your consent before collecting and further processing your personal data.
We use your personal data for the following purposes:
- To verify your log-in details and enable you to launch the Business Center App;
- To help you trace your professional development and learning experience;
- To share User Contributions you posted on public areas of websites you access through the Business Center App;
- To offer you all other functionalities of the Business Center App that you requested and to communicate with you to provide you with information about the products, services and features we offer through the Business Center App;
- To notify you about changes to the Business Center App and this Notice;
- To allow us to show you relevant content in the Business Center App;
- To measure or understand the effectiveness of advertising we serve to you, and to deliver relevant advertising to you in the Business Center App;
- To review, analyze and evaluate your use of (or your decision not to use) our products and services in order to develop and improve the quality of our offering and strengthen our relationship with you and our other existing and potential customers;
- To ensure the technical security of the Business Center App;
- To ensure that our data records are accurate and up to date;
- To administer the Business Center App and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;

How We Share Your Personal Data
Amway does not sell, rent or trade your personal data. Amway only shares your personal data with:
- Entities within the Amway group for which it is reasonably necessary or desirable to access and process your personal data;
- Other ABOs, to allow communication regarding Amway products, services and orders;
- Third-party service providers, such as providers of Infrastructure- or Platform- or Software-as-a-Service solutions, software development services, information system maintenance services, record management services or marketing services, social media service providers and reward certificate service providers;

This Privacy Notice describes how Amway Corp., 7575 Fulton Street East, Ada, MI 49355 USA (“Amway” or “we” or “us”), use personal information collected or received from users (“Users” or “you”) of this App (“Amway Wellbeing+ App”). It describes how we collect or receive your personal information, the types of personal information we process, how we use, share and protect these data, how long we retain these data, your rights with respect to the processing of your personal information, and how you can contact us about our privacy practices. We act as joint controllers in relation to your personal information.

How We Collect and Receive Personal Information from You
Where we ask you to provide us with your personal information, we will indicate whether providing the personal information is a statutory or contractual requirement, or a requirement necessary to enter into and/or facilitating a contract, as well as whether you are obliged to provide the personal information and of the possible consequences of a failure to provide the personal information.
Amway collects and receives personal information from Users in various ways, such as:
App functional information. We collect personal information that you provide to us while using Amway Wellbeing+ App. Each time you use Amway Wellbeing+ App we may automatically collect required information about how you access and use Amway Wellbeing+ App including, for example, login information or completion of a training.
App Analytics. We further collect usage information when you access, view, and use the Amway Wellbeing+ App. Your data is used for anonymous usage statistics, and we will not link any provided information directly to you.
Contacting Us. When you contact us through the various communication channels provided, we collect personal information and other information that you provide. Examples of such personal information include Amway e-mail addresses, telephone numbers or online forms.
The Types of Personal Information We Process
We process the following types of personal information relating to you:
- Customer or IBO registration number and login or access credentials retained on your device (such as Amway ID and password);
- Program based activity information to inform you and, for registered customers, your IBO on your program progress.
- Through App Analytics listed above under the section “How We Collect or Receive Personal Information from You” we collect information regarding your Amway Wellbeing+ App usage, IP-address and operating system;
- Further the Amway Wellbeing+ App records the following information on your device. This information is not shared with Amway:
- Health assessment responses and health scores;
- Habit tracking information: steps taken, food logged, hydration intake, exercise time, mindfulness, activities, mood recorded, supplements logged.
In addition, when you communicate with us through various communications channels, we collect your contact details, such as your name, email address, address, telephone number, and/or fax number. You may also voluntarily provide other personal information in connection with your inquiries or comments. We encourage you, however, to provide no more personal information relating to you than is necessary in order for us to provide an appropriate response to your inquiries or comments.
We may process other personal information in exceptional circumstances only. If we need to process other types of personal information about you, we will make sure that you are informed about the processing of such personal information and that there is a valid legal basis for doing so (e.g., your consent).
How We Use the Personal Information We Collect
We only process your personal information to the extent it is necessary:
(i) For the performance of an agreement (such as among others, the End User Licence Agreement of Amway Wellbeing+ App or the IBO contract;) with us or in order to take steps at your request prior to entering into an agreement with us;
(ii) To comply with our legal obligations, including to:
- Comply with laws which require us to retain records; and
- Comply with any other laws which may be applicable to us.
(iii) For the purpose of our legitimate interests, including to:
- Address your comments or inquiries;
- Communicate with you;
- Operate, evaluate, and improve our products, business, and services, including by:
o Tracking and analyzing your use of our services;
o De-identifying your personal information in order to carry out analysis on information which does not identify you; and
o Improving our services;
- Prevent and protect you, us, and others against fraud, unauthorized transactions, claims, and other liabilities;
- Ensure compliance with company policies and industry standards; and
- Process personal information for internal administrative purposes.
How We Share Personal Information
Amway does not sell, rent, or trade your personal information. We do share your personal information among us as joint controllers and with:
- Related entities operating direct selling businesses around the world under the company name Amway, to whom it is reasonably necessary or desirable for Amway to disclose personal information;
- Providers of infrastructure- or platform- or software-as-a-service solutions, software development services, information system maintenance services, record management services or marketing services;
- Government authorities or other third parties, if required or allowed otherwise by law or reasonably necessary to protect the rights, legal interests, property, or safety of you, others, or ourselves.
- If applicable and depending on the program, program based activity information may be shared with the respective (e.g. running) group or team, and/or with the ABO.
International Data Transfers
We transfer the personal information we collect about you to entities within the Amway organization, as well as to third-party service providers that process personal information on our behalf. Some of these companies and service providers are located in countries other than the country in which the personal information was originally collected. The right to access

Thank you for using the Health and Wellness app (the “App”). This App is powered by Alticor Inc. (“Amway”) and made available by Amway as a service. All content, information, and services provided on and through our App may be used only under the following terms and conditions, as they are amended from time to time (the “Terms”). As used herein, the terms “our,” “we,” and “us” refer to Amway.
YOUR USE OF OUR APP CONSTITUTES YOUR AGREEMENT TO BE BOUND BY THESE TERMS. PLEASE READ THEM CAREFULLY BEFORE USING THE APP. IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, YOU MUST NOT USE OUR APP. IF YOU ARE AN ABO, YOU ARE BOUND BY ADDITIONAL TERMS AND CONDITIONS CONTAINED IN YOUR AMWAY AUTHORIZATION AND CONTRACT AND THE ABO RULES OF CONDUCT.
- APP USE GENERALLY
1.1. Your User License. You are granted a limited, nonexclusive, nontransferable license to access download, install, and use the App and its content for your personal, non-commercial use on mobile devices owned or otherwise controlled by you (“Mobile Device”) strictly in accordance with the App’s documentation and these Terms. If you are under 18 years of age, you may not use the App. Our App contains information that is appropriate for access and use in countries and markets where we make the information available (“Applicable Markets”). We make no representation that any materials contained in the App are appropriate or available for use from territories where their contents are illegal or prohibited. Any references in the App to specific products or services are applicable only to those available in the Applicable Markets, and any product claims and comparisons to other products in the App apply within the Applicable Markets only. Those who use the App are responsible for compliance with local laws, including laws regarding the transmission of technical data exported from Europe, the U.S., or the territory in which they reside. We reserve the right to refuse service in our sole discretion and without notice. You are solely responsible for your use of the App, and you agree to compensate, hold harmless, and defend us from any claims, damages, losses, liabilities, costs, and expenses, including attorneys’ fees, resulting from your use or misuse of the App. Posting or transmitting any unlawful, infringing, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic, or profane material, or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law, is strictly prohibited.
1.2. Limitations on Your Use. No material from our App may be copied, reproduced, republished, downloaded, posted, displayed, transmitted, or distributed in any way, without Amway’s prior written permission, except that you may download one copy of the materials on any single computer for your personal, noncommercial home use only, provided that (i) you keep intact all copyright and other proprietary notices, and (ii) you make no modifications to the materials. You may not, without our prior written permission, frame or mirror any material contained in the App on any other server. The unauthorized use of any such material on any other website or computer environment is expressly prohibited. All trademarks, service marks, trade names, and trade dress are proprietary to Amway or its licensors.
1.3. Privacy and Your Personal Information. We collect and use your personal information in accordance with our Privacy Notice.
1.4. Identifiers. It is your responsibility to safeguard the password you use to access our App, and to promptly advise Amway or your ABO if you ever suspect that your password has been compromised. We strongly encourage you to change your password regularly to prevent unauthorized access. Because your identification number and password are specific to you, you acknowledge sole responsibility for any and all use of our App conducted with your identification number and password.
1.5. Intellectual Property Rights
1.5.1. Copyright. The App design, text, content, selection and arrangement of elements, organization, graphics, compilation, magnetic translation, digital conversion, and other matters related to the App are protected under applicable copyright laws, ALL RIGHTS RESERVED. The posting of any such elements in the App does not constitute a waiver of any right in such elements. You do not acquire ownership rights to any such elements viewed through the App. Except as otherwise provided herein, none of these elements may be used, copied, reproduced, downloaded, posted, displayed, transmitted, modified, or distributed in any form or by any means, including, without limitation, electronic, mechanical, photocopying, recording, or otherwise, without Amway’s prior written permission. You acknowledge and agree that the App is provided under license, and not sold, to you. You do not acquire any ownership interest in the App under these Terms, or any other rights thereto other than to use the App in accordance with the license granted, and subject to all terms, conditions, and restrictions, under these Terms. Amway and its licensors and service providers reserve and shall retain their entire right, title, and interest in and to the App, including all copyrights, trademarks, and other intellectual property rights therein or relating thereto, except as expressly granted to you in this Agreement.
1.5.2. Trademark. Amway, the Amway logo, and all product names, company names, and all other trademarks and logos, unless otherwise noted, are trademarks and/or trade dress of Amway or its affiliates or other companies under common ownership or control or their licensors (the “Marks”). The use or misuse of any Marks or any other materials contained in the App, without the prior written permission of their owner, is expressly prohibited.
1.6. Content and Services. The App may provide you with access to Amway or its Affiliates’ website (the “Website”) and products and services accessible thereon, and certain features, functionality, and content accessible on or through the App may be hosted on the Website (collectively, “Website Content and Services”). Your access to and use of such Website Content and Services are governed by Website’s Terms of Use and Privacy Policy or Privacy Notice, as applicable, which are incorporated herein by this reference. Your access to and use of such Website Content and Services may require you to acknowledge your acceptance of such Terms of Use and Privacy Policy or Privacy Notice, as applicable, and/or to register with the Website, and your failure to do so may restrict you from accessing or using certain of the App’s features and functionality. Any violation of such Terms of Use will also be deemed a violation of these Terms.
1.7. Termination. These Terms are effective until terminated by Amway. Your rights under these Terms will terminate automatically if you fail to comply with any of its terms.
- CONTENT POSTED BY USERS
2.1. Content
2.1.1. You may see or read things that you do not like or agree with in our App. You understand that by using our App, you may be exposed to information, data, text, software, music, sound, photographs, graphics, video, messages, products, services, and other materials (collectively, “Content”) that is offensive, indecent, or objectionable.
2.1.2. Any material, information, or idea you submit to us or the App by any means may be disseminated or used by us without compensation or liability to you for any purpose whatsoever, including, but not limited to, developing, manufacturing, and marketing products. We have no obligation to keep any submissions confidential, return any materials that you submit to us, or compensate you for the use of any such materials under any circumstances. You hereby irrevocably waive any claims based on our use of any materials, ideas, or information that you submit to us.
2.1.3. We reserve the right to monitor some, all, or none of the areas of the App for adherence to these Terms.
2.2. Content License. We do not claim ownership of the Content you upload, place, or post through the App. You are responsible for protecting your rights in such Content and are not entitled to our help in protecting such Content. By uploading, placing, or posting Content through the App, you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, and fully sublicensable license, under all intellectual property and other rights, including, without limitation, privacy and publicity, to use, distribute, reproduce, modify, adapt, translate, publicly perform, publicly display, transmit, exploit, create derivative works from the Content (in whole or in part), and incorporate such Content into other works in any format or medium now known or later developed, for any purpose associated with the App. You grant us and our sub-licensees the right to use the name that you submit in connection with such Content, if we choose. You hereby irrevocably waive any claims based on “moral rights” and similar theories, if any. Please note, however, that certain activities (e.g., contests) that involve the submission of Content by you may have terms applicable to your Content that differ from those above. In the event such terms differ with these Terms, such terms will govern and have precedence over these Terms with respect to your Content.
- YOUR CONDUCT
3.1. Your Authorization to Use the App. Your authorization to use the App and contribute to it depends on your compliance with community standards and the conduct guidelines set forth below. If you fail to conduct yourself appropriately, we may revoke your privileges to use all or a portion of the App and/or take other appropriate measures to enforce these community standards and conduct guidelines.
3.2. Conduct Guidelines/Community Standards. The following is a non-inclusive list of behaviors that are not permitted in the App. You agree not to:
3.2.1. upload, post, transmit, or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy (up to, but not excluding any address, email, phone number, or any other contact information without the written consent of the owner of such information), hateful, or racially, ethnically, or otherwise objectionable;
3.2.2. harm minors in any way;
3.2.3. impersonate any person or entity, including, but not limited to, any of our members, company officials, directors, shareholders, agents, representatives or users, or falsely state or otherwise misrepresent your affiliation with a person or entity;
3.2.4. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content posted, transmitted, or otherwise made available through the App;
3.2.5. upload, post, or otherwise transmit any Content that you do not have a right to upload, post or otherwise transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
3.2.6. upload, post, or otherwise transmit any Content or otherwise engage in any activity that infringes, violates, or interferes with any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary rights of any party;
3.2.7. upload, post, or otherwise transmit unsolicited commercial email or “spam.” This includes unethical marketing, advertising, “chain letters,” or any other practice that is in any way connected with “spam,” such as (a) sending mass email to recipients who haven’t requested email from you or with a fake return address, (b) promoting a site with inappropriate links, titles, descriptions, or (c) promoting your site by posting multiple submissions in public forums that are identical;
3.2.8. upload, post, or otherwise transmit any material that contains software viruses, Trojan horses, malware or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment, or intercept messages sent from a computer or communications device;
3.2.9. interfere with or disrupt the App, servers, or networks connected to the App, or disobey any requirements, procedures, policies, or regulations of networks connected to the App;
3.2.10. intentionally or unintentionally violate any applicable local, state, national, or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including without limitation, the New York Stock Exchange, the American Stock Exchange, or the NASDAQ, and any regulations having the force of law;
3.2.11. “stalk” or otherwise harass another;
3.2.12. promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, without limitation, providing instructions on how to assemble bombs, grenades, and other weapons or incendiary devices;
3.2.13. offer for sale or sell any item, good, or service through our App;
3.2.14. use the App as a forwarding service to another website;
3.2.15. allow usage by others in such a way as to violate these Terms or any other Amway website policy;
3.2.16. take any steps to interfere with or in any manner compromise any of our security measures;
3.2.17. use the App for fraudulent purposes;
3.2.18. harvest or collect any information about or regarding other Account holders, including, without limitation, any personal data or information;
3.2.19. sell, lend, lease, trade, rent, barter, sublicense, assign, transfer, or grant rights in any manner to your Account, or password, including, without limitation, on or through the use of any third-party website or service;
3.2.20. copy the App or any portion thereof;
3.2.21. remove any proprietary notices from the App;
3.2.22. cause, permit, or authorize the modification, creation of derivative works, or translation of the App without our express permission;
3.2.23. sell, assign, rent, lease, act as a service bureau, or grant rights in the App including, without limitation, through sublicense, to any other person or entity;
3.2.24. attempt to decompile, reverse engineer, disassemble, modify, or hack the App or to defeat or overcome any encryption and/or digital rights management technology implemented by us with respect to data transmitted, processed, or stored by us or the App;
3.2.25. use the App in any manner not permitted by these Terms, or otherwise exceed the scope of our services that you have signed up for (i.e., by accessing and using the tools that you do not have a right to use).
- WARRANTY DISCLAIMER AND INDEMNIFICATION. OUR APP AND ITS CONTENTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH NO WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT, AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE. WE MAKE NO REPRESENTATION OR WARRANTY WHATSOEVER REGARDING THE COMPLETENESS, ACCURACY, CORRECTNESS, INTEGRITY, RELIABILITY, CURRENCY, ADEQUACY, SUITABILITY, FUNCTIONALITY, AVAILABILITY, OR OPERATION OF THIS APP OR THE CONTENT OR SERVICES PROVIDED ON, OR ACCESSIBLE FROM, THIS APP. WE DO NOT WARRANT THAT THE OPERATION OF THIS APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THIS APP IS FREE FROM VIRUSES AND OTHER HARMFUL COMPONENTS TO EQUIPMENT OR SOFTWARE.
You agree to indemnify and hold Amway, and its parents, subsidiaries, affiliates, officers, agents, co-branders, partners, licensors, and employees, harmless from any alleged claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your Content, your use of this App, your connection to the App, your violation of these Terms or any other applicable policy, your violation of any rights of another, or breach of any representation or warranty made by you under these Terms, whether you are a registered user or not. You are solely responsible for your actions when using the App, including, but not limited to, costs incurred for Internet access.
- LIMITATION OF LIABILITY. IN NO EVENT WILL WE BE LIABLE, NOR DO WE ASSUME RESPONSIBILITY, FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THIS APP (OR THE CONTENT OR SERVICES PROVIDED ON, OR ACCESSIBLE FROM, THIS APP), OR OTHERWISE, EVEN IF WE ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- SATISFACTION GUARANTEE. Amway is a recognized leader in the industry for offering superior value in a high-quality product line. We stand behind the quality of our products and guarantee your satisfaction. If for any reason you try our products and are not completely satisfied, you may return any unsatisfactory products according to the Satisfaction Guarantee in the Applicable Markets for refund of the product price and applicable tax. This satisfaction guarantee does not apply to ABO purchases for stock or inventory.
- CONFIDENTIALITY. For ABOs with a business powered by Amway, your user license includes a revocable right to access and use certain trade secret, confidential, and proprietary business information, which includes, without limitation, Line of Sponsorship (“LOS”) information, i.e., information compiled by Amway that discloses or relates to all or part of the specific arrangement of sponsorship within the Independent Business Ownership Plan, including, without limitation, ABO lists, sponsorship trees, and all ABO contact and business performance information generated therefrom (“Proprietary Information”), which may be made available to you on App. You acknowledge that Amway is the exclusive owner of all Proprietary Information and agree to maintain all Proprietary Information in strictest confidence and to use it only as authorized by Amway. You agree not to compile, organize, access, create lists of, or otherwise use Proprietary Information except as authorized by Amway under the ABO Rules of Conduct and the regulations and procedures outlined in the Business Reference Guide, as amended.
- GENERAL TERMS
8.1. Errors and Corrections. While we use reasonable efforts to include accurate and current information on our App, we do not warrant or represent that the App will be error-free. Data entry errors or other technical problems may sometimes result in inaccurate information being shown. We reserve the right to correct any inaccuracies or typographical errors on our App, including pricing and availability of products and services, and shall have no liability for such errors. 8.2. Updates. We may from time to time in our sole discretion develop and provide App updates, which may include upgrades, bug fixes, patches, other error corrections, and/or new features (collectively, including related documentation, “Updates”). Updates may also modify or delete in their entirety certain features and functionality. You agree that we have no obligation to provide any Updates or to continue to provide or enable any particular features or functionality. Based on your mobile device settings, when your mobile device is connected to the internet either: (a) the App will automatically download and install all available Updates; or (b) you may receive notice of or be prompted to download and install available Updates. You shall promptly download and install all Updates and acknowledge and agree that the App or portions thereof may not properly operate should you fail to do so. You further agree that all Updates will be deemed part of the App and be subject to all terms and conditions of these Terms.
8.3. Governing Law and Jurisdiction. These Terms are governed by and construed in accordance with the laws of Michigan, without giving effect to conflict of law principles. Any controversy or dispute arising out of your use of our App shall be submitted, and you irrevocably consent, to the jurisdiction of the courts located in Kent County, Michigan, United States. If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed removed and shall not affect the validity and enforceability of any remaining provisions.
8.4. Limitation of Time to File Claims. ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES OTHERWISE SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

You shall not, directly or indirectly, export, re-export, or release the App to, or make the App accessible from, any jurisdiction or country to which export, re-export, or release is prohibited by law, rule, or regulation. You shall comply with all applicable federal laws, regulations, and rules, and complete all required undertakings (including obtaining any necessary export license or other governmental approval), prior to exporting, re-exporting, releasing, or otherwise making the Application available outside the US.

Updated versions of the Terms will be made available via the App and are effective immediately. Please check back frequently to see if these Terms have changed. Continued use of the App after any changes to the Terms constitutes your consent to such changes.
8.7. Waiver and Severability. No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of that or any other right hereunder. In the event of a conflict between these Terms and any applicable purchase or other terms, the terms of these Terms shall govern. If any provision of these Terms is illegal or unenforceable under applicable law, the remainder of the provision will be amended to achieve as closely as possible the effect of the original term and all other provisions of these Terms will continue in full force and effect.

You do not acquire ownership rights to any such elements viewed through the App. Except as otherwise provided herein, none of these elements may be used, copied, reproduced, downloaded, posted, displayed, transmitted, modified, or distributed in any form or by any means, including, without limitation, electronic, mechanical, photocopying, recording, or otherwise, without Amway’s prior written permission. You acknowledge and agree that the App is provided under license, and not sold, to you. You do not acquire any ownership interest in the App under these Terms, or any other rights thereto other than to use the App in accordance with the license granted, and subject to all terms, conditions, and restrictions, under these Terms. Amway and its licensors and service providers reserve and shall retain their entire right, title, and interest in and to the App, including all copyrights, trademarks, and other intellectual property rights therein or relating thereto, except as expressly granted to you in this Agreement.

Amway, the Amway logo, and all product names, company names, and all other trademarks and logos, unless otherwise noted, are trademarks and/or trade dress of Amway or its affiliates or other companies under common ownership or control or their licensors (the “Marks”). The use or misuse of any Marks or any other materials contained in the App, without the prior written permission of their owner, is expressly prohibited.
1.6 Content and Services. The App may provide you with access to Amway or its Affiliates’ website (the “Website”) and products and services accessible thereon, and certain features, functionality, and content accessible on or through the App may be hosted on the Website (collectively, “Website Content and Services”). Your access to and use of such Content and Services are governed by Website’s Terms of Use and Privacy Policy which are incorporated herein by this reference. Your access to and use of such Website Content and Services may require you to acknowledge your acceptance of such Terms of Use and Privacy Policy and/or to register with the Website, and your failure to do so may restrict you from accessing or using certain of the App’s features and functionality. Any violation of such Terms of Use will also be deemed a violation of this Agreement.
1.7 Termination. These Terms are effective until terminated by Amway. Your rights under these Terms will terminate automatically if you fail to comply with any of its terms.
